Terms of Use

Agreement and eligibility

By accessing a proof-of-concept application from POP, Inc. (the “Prototype”) or opting in to the Prototype App Messaging Program, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Prototype or enroll in the program.

You must be at least 18 years old, or the age of legal majority where you live, and authorized to use the mobile number you provide.

Purpose of the Prototype

The Prototype is a limited, pre-release experience created for evaluation, research, demonstration, or usability testing. It is not a final commercial product. Features, data, messages, and availability may change or be removed at any time.

SMS consent and message types

When you knowingly provide your mobile number and agree to receive texts, you authorize POP, Inc. to send automated or manually generated messages about the specific Prototype identified at opt-in. Messages may include testing instructions, reminders, account or security notices, status updates, and other non-marketing notifications connected to your participation.

Your consent is specific to POP, Inc., the disclosed Prototype, and the disclosed message topic. It is not transferable to another company, client, program, or topic. Consent is not a condition of purchase.

Frequency, charges, and delivery

Message frequency varies based on activity, but you will receive no more than 4 messages per month for each Prototype program unless a different limit is clearly disclosed when you opt in. Message and data rates may apply. Your carrier’s rates and plan terms control.

Messaging may not be available on every device or carrier. Delivery is not guaranteed and may be delayed or blocked by networks, devices, or other circumstances outside our control. Carriers are not liable for delayed or undelivered messages.

Opting out and getting help

You may revoke consent at any time by replying STOP to any message. We may send one final message confirming your opt-out, and then we will stop SMS messages for that program unless you later provide new consent.

Reply HELP for help or email info@wearepop.com. If you change or deactivate your mobile number, please opt out first or notify us so the next user of that number does not receive messages intended for you.

Acceptable use

You agree not to:

• Use the Prototype for unlawful, harmful, or deceptive activity.
• Try to bypass security, access controls, or usage limits.
• Interfere with the Prototype or another participant’s testing.
• Submit malicious code or content you do not have the right to use.
• Treat sample data, simulated notices, or Prototype output as a final business, financial, medical, or legal decision.

Prototype content and feedback

POP, Inc. and its licensors retain their rights in the Prototype and its content. We give you a limited, temporary, revocable right to use it only for the authorized evaluation.

If you provide feedback, you allow us to use it without restriction or payment to improve concepts, designs, and services. Any separate confidentiality or testing agreement between you and POP, Inc. continues to apply.

Disclaimers and limits

The Prototype is provided “as is” and “as available” for evaluation. To the fullest extent permitted by law, POP, Inc. disclaims implied warranties and is not responsible for losses caused by reliance on incomplete, simulated, delayed, or inaccurate Prototype content.

To the fullest extent permitted by law, POP, Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the Prototype or the Prototype App Messaging Program. Some jurisdictions do not allow certain exclusions, so these limits may not fully apply to you.

Suspension, changes, and contact

We may suspend or end access to the Prototype or the Prototype App Messaging Program at any time, including when testing ends or these terms are violated. We may update these terms as the Prototype or legal requirements change. The “Last updated” date shows when revisions took effect.
